Terms of Use
Kraken's Crew (in Slovak "Cez palubu!") – a party game for iOS and Android.
Effective from 1 October 2026.
1. Who we are
The game is provided by Martin Mucha, Košice, Slovakia, company ID 57 799 032 ("we"). Contact: mucha.muca@gmail.com.
By installing or playing the game you agree to these terms. If you do not agree, please do not use the game.
2. What you may do
We give you a personal, non-exclusive, non-transferable licence to install the game on devices you own or control and to play it for your own entertainment, including with friends at your table.
You may not copy, resell or redistribute the game or its parts, extract its artwork, sounds, music or voice recordings, or use them outside the game, unless the law or an open-source licence expressly allows it. The licences of the open-source libraries, fonts, sounds and music used in the game are listed in the app under Rules → Privacy & licences.
3. Price and purchases
The game is free and has no ads. It currently sells nothing.
If paid expansions or cosmetic packs are added later, they will be sold through the Apple App Store or Google Play. The price is shown before you buy, payment and refunds follow the rules of that store, and purchases can be restored on your devices with "Restore purchases". Your statutory consumer rights are not affected.
4. Playing at a shared table
When everyone plays on their own phone, the name, pirate and – if you choose so – a small thumbnail of your photo are shown to the other players at that table. Please:
- use only a photo of yourself, or a picture you have the right to use, and only with the consent of anyone shown in it,
- do not use names or pictures that are illegal, offensive, sexual, hateful or that harass others,
- do not try to disturb other people's tables, guess table codes or overload the servers.
The host of a table can hide any photo and remove any player. We may limit or block access from networks that abuse the service. Tables are temporary: they are deleted when the host closes them, at the latest after 6 hours without activity, and cannot be restored.

5. Questions you send us
If you send a question through "Write to us", you allow us to use its text, free of charge and without naming you, to improve the game – for example to add a new answer to Ask the Captain. Please do not include personal information.
6. Internet and availability
Playing on one phone works without the internet. Tables where everyone plays on their own phone need an internet connection on every phone. We run the servers with reasonable care, but we do not promise they will always be available; capacity may be limited at busy times, and in that case you can still play on one phone. Your mobile operator may charge you for data.
7. Who can play
The game is meant for players aged 13 and over. If you are under 18, play with the agreement of a parent or guardian, especially before making any purchase. The game is a social game of bluffing among friends; nothing in it is real, and being "thrown overboard" only means leaving the round.
8. The Captain's voice
The Captain's voice was created with AI voice models. It is not the voice of a real person.
9. Our rights
The game, its name, logo, texts, artwork, recordings and code belong to us or to our licensors and are protected by law. These terms do not give you any rights to them beyond the licence in section 2.
10. Warranty and liability
The game is provided "as is". It is free entertainment, and to the extent the law allows, we give no guarantee that it will be free of errors or always available, and we are not liable for indirect or consequential damage or for lost data saved on your device.
Nothing in these terms limits liability that cannot be limited by law – in particular for damage caused intentionally or by gross negligence, or for injury to life or health – or the rights you have as a consumer under the mandatory law of the country where you live.
11. Ending and changes
You can stop using the game at any time by uninstalling it. We may change or stop offering the game, or parts of it. We may also update these terms; the current version is always available at the address where you are reading this, with the date at the top. If a change is important, we will point it out in the app or in the release notes.
12. App stores
The game is distributed through the Apple App Store and Google Play, and their terms apply alongside these. These terms are between you and us, not with Apple or Google. Apple and Google are not responsible for the game or its content, have no obligation to provide maintenance or support for it, and are not responsible for handling claims relating to it. For the version downloaded from the App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Where these terms and Apple's Licensed Application End User License Agreement differ on a point that Apple requires, Apple's agreement takes precedence.
13. Law and disputes
These terms are governed by the law of the Slovak Republic. If you are a consumer, you keep the protection of the mandatory provisions of the law of the country where you live, and you may bring a claim in the courts of that country.
If you are a consumer and are not satisfied with how we handled your complaint, you may ask for an out-of-court settlement through an alternative dispute resolution body – in Slovakia for example the Slovak Trade Inspection (Slovenská obchodná inšpekcia, soi.sk).
